Success Stories: Adjustment of status application approved for Filipino-German stepdaughter of U.S. citizen

Photo by Manny Moreno on Unsplash. Adjustment of Status is the process wherein a non-citizen present in the United States applies for permanent residency while in the country by filing the application with the USCIS, without having to leave the United States.

We recently received an approval of lawful permanent residence (a green card) for a Filipino-German national adjustment of status applicant through her U.S. citizen stepfather at the U.S. Citizenship and Immigration Services (USCIS) Houston, TX Field Office. Congratulations to our clients!

The beneficiary originally entered the United States on ESTA under the Visa Waiver Program to accompany her family while on a planned temporary visit for medical reasons. The family lived in the Philippines where the children were born but their situation changed and they decided to live in the United States on a permanent basis.

Ordinarily, individuals entering under the Visa Waiver Program (VWP) are ineligible to adjust their status and must leave the United States before the expiration of their 90-day period of authorized stay. However, there is an exception for immediate relatives of U.S. citizens which allows them to adjust their status and obtain permanent residence in the United States even after their VWP period has expired.

Under U.S. immigration law, immediate relatives are spouses, unmarried children under 21 years old, and parents of adult U.S. citizens. The law also allows for any stepchildren to immigrate or adjust their status if the stepparent married the child’s birth parent before the child’s 18th birthday.
