Success Stories: I-130 Petition approved at USCIS for Filipino child of U.S. citizen who was born out-of-wedlock

We recently received an approval at the U.S. Citizenship and Immigration Services (USCIS) of an I-130 Petition for Alien Relative for a national of the Philippines who is the minor child of a U.S. Citizen who was born out of wedlock. Congratulations to our clients!

If a child’s parents are not married at the time of their birth, they are considered a “child out of wedlock.” Such a child can generally immigrate through their mother without any special considerations; however, if the child immigrates through their father, there are additional requirements. The father must either provide a bona fide parental relationship with the child before the child turns 21 years old; or prove that the father had “legitimated” the child under the law of the child’s or the father’s domicile.

The beneficiary is a teenager who is the minor child of a U.S. citizen. He was born out of wedlock to his U.S. citizen father and his Filipina mother. In this case, we submitted documentation that demonstrated a bona fide parental relationship between the beneficiary child and his petitioning father and the petition was approved without a request from evidence from USCIS! Now, the beneficiary will be consular processing at the U.S. Consulate in Manila.
