The 5th Amendment: Guarantees your right to remain silent; you do not have to answer questions about where you were born or how you entered the country.
The 6th Amendment: Gives you the right to speak to a lawyer. While the government does not provide a free lawyer in immigration court, you have the right to hire one.
2. The Difference in Warrants
Identifying the type of document an agent holds is critical for protecting your home.
Judicial Warrant: This is signed by a judge or a court and does authorize agents to enter your home.
ICE Administrative Warrant: This is signed by an immigration official, not a judge, and it does not give agents the legal right to enter your home without your verbal consent.
3. Step-by-Step Encounter Guide
Knowing how to react in different scenarios can protect you from additional charges.
In a Car/Traffic Stop: Stop in a safe place, keep your hands visible, and remember you can refuse consent for a vehicle search.
In Public/Subway: Stay calm and do not run. If you are not under arrest, ask, "Am I free to go?" If the answer is yes, walk away calmly.
